Many Lockheed Martin products are subject to export restrictions under U.S. law because they include encryption technology. A branch of the U.S. Department of Commerce known as the Bureau of Industry and Security regulates exports through the Export Administration Regulations. These regulations spell out the export restrictions on a wide variety of goods, software, and technologies.

Additionally, both the Department of Treasury and the Department of State regulate and control other types of export-related technology and product transfers and transactions. The Office of Foreign Assets Control (OFAC) of the U.S. Department of the Treasury administers and enforces economic sanctions against certain countries and regimes, terrorists, and other threats to U.S. national security, foreign policy or economic interests.

Just because an item is subject to U.S. export controls does not necessarily mean it cannot be exported.

Without limitation, parties acquiring software from Lockheed Martin are responsible for obtaining all licenses or other approvals necessary for downloading or transfer of the software or use of the service. A party may not transfer the software or services without U.S. Government permission to (a) anyone on the U.S. Treasury Department’s lists of Specially Designated Nationals (including the Government of Iran, Government of Sudan, Government of Cuba, prohibited members of the Cuban Communist Party), or on the U.S. Commerce Department’s Denied Persons List, Entity List, or Unverified List, or on the U.S. State Department’s Debarred List or Nonproliferation List (see Commerce Lists to Check); or (b) for use with chemical or biological weapons, sensitive nuclear end-uses, or missiles to deliver them.

Lockheed Martin uses this portion of its web site to communicate export control information specific to its products to our customers and partners. This information may be required for shipping documentation, record keeping, or post-shipment reporting.

Term Definition

  • Product: A logical grouping of products. Unless otherwise specified, a product family includes all versions, languages, service packs, kits, customer service disk kits, documentation kits, updates, etc. for that family.
  • ECCN: Export Control Classification Number assigned by the U.S. Department of Commerce, Bureau of Industry and Security (BIS) in the Commerce Control List (CCL). This is the fundamental designation indicating the level of control for an item.
  • Commercial: This designation is assigned to software products that have been classified as Commercial Software.
  • Restricted vs. Unrestricted: The U.S. government regulations for License Exception ENC differentiate between “Restricted” and “Unrestricted” software. An “Unrestricted” in this column indicates that the software is eligible for “ENC” under Sections 740.17(a) and 740.17(b)(3) of the EAR.
  • Mass Market: The U.S. government regulations allow mass market encryption products containing strong encryption to be exported under 5D992, NLR (see above) after a 30-day review. A “Mass Market” in this column indicates that the software has been reviewed by the U.S. Government and has been approved as mass market software.
  • CCATS: Commodity Classification Automated Tracking System. This is the code number assigned by BIS to products that it has classified against the Commerce Control List (CCL). Microsoft provides the CCATS number when applicable. We provide the CCATS because some encryption exports require post-shipment reporting to BIS and the CCATS information will assist with the reporting requirements, if required.
  • LIC: Given the appropriate ECCN, you should consult the Export Administration Regulations (EAR) or counsel to determine the appropriate license type and eligible countries for export purposes.
  • ITAR Controlled: This designation differentiates if a software product contains any ITAR controlled information.
  • USML: The United States Munitions List (USML) is a list of articles, services, and related technology designated as defense-related by the United States federal government. These articles fall under the export and temporary import jurisdiction of the Department of State.
  • Proprietary / Trademark: This designation is assigned to software products that contain Lockheed Martin proprietary information, or have external companies maintaining trademarks.
